The legal standard for incitement is strict for a reason: It would be very easy to crush political speech that makes those in power unhappy, labeling it as criminal.

That's why the Supreme Court ruled speech is not punishable unless it is "directed to inciting or producing imminent lawless action and is likely to incite or produce such action."
