I'm working my way through Michelle Alexander's "The New Jim Crow" right now.

The US Supreme Court jurisprudence preventing the litigation of allegations of racial discrimination is really outrageous.

For example, Alexander v Sandoval (2001) outright denies a private right of action under Title VI of the Civil Rights Act of 1964 in cases of disparate impact.

Disparate impact is when a policy notably negatively affects a minority group compared to the general population.

McCleskey v Kamp (1987) did something similar, requiring proof of intent (not disparate impact) to allege racial discrimination in death penalty cases. Proof of intent is almost impossible to show unless the prosecutor is stupid enough to go off on a racist rant sometime.

I knew it was bad, but not that bad.

Hey, just so you know: if you use the term "boomer" in a derogatory way in your post, you're blocked. Your #boomer parents sacrificed and sweat in order to provide you (or perhaps your parents) with a safe and carefree (as safe and carefree as your family's circumstances allowed) childhood. They made sure you got an #education.

They also went to demonstrations in the 60s and 70s. They (and their greatest-generation parents) gave us the #CivilRightsAct and widely available birth control; they helped end the Vietnam war. And in fact, today, when I (one of the youngest boomers) go to demonstrations, I find them heavily populated by my generation, some waving signs reading "I can't believe I have to #protest this again".

You don't like the state of the world? Neither did we. We did something about it. How about you?

August 29, 1957 - The U.S. Congress passed the Civil Rights Act, the first such law since reconstruction. The bill established a Civil Rights Commission which was given the authority to investigate discriminatory conditions. A Civil Rights Division was created in the Department of Justice, allowing federal prosecutors to obtain court injunctions against interference with the right to vote, among other things.

In an ultimately futile attempt to block passage, then-Democrat, former Dixiecrat, and later Republican Senator Strom Thurmond of South Carolina set the all-time (at that time) filibuster record: 24 hours, 19 minutes of non-stop speaking on the floor of the Senate. A filibuster is the deliberate use of prolonged debate and procedural delaying tactics to block action supported by a majority of members. It can only be stopped with a 60% majority voting to end debate.

June 19, 1964 - The Civil Rights Act of 1964 was approved after surviving an 83-day filibuster in the United States Senate. The new law, initiated and passed through the determination of President Lyndon Johnson and Senate Republican leader Everett Dirksen of Illinois, guaranteed for the first time equal access to public accommodations “without discrimination or segregation on the ground of race, color, religion, or national origin.”

The Senate had never before voted to end the filibuster of a civil rights bill, all of which were consistently opposed by the bloc of senators from the South. Following Senator Robert Byrd's (D-West Virginia) 14+ hour-long speech, Senator Dirksen rose to speak, "We dare not temporize with the issue which is before us. It is essentially moral in character. It must be resolved. It will not go away. Its time has come."

The of 1964 was not signed into law because of peaceful sit-ins, it was the riots engulfing the country.

The more I watch them in action, the more it becomes clear to me that the inversion of civil rights language and protections is a foundational aspect of the methodology the Trump regime is using to transform America into a fascist dictatorship with open nazi characteristics. While I think this write up in the Guardian could use a bit more blunt honesty about the white nationalist nature of the Trump administration's strategy here, but it still does a pretty good job of looking at all the ways the regime is purposing one (itself white nationalist) SCOTUS ruling to turn sixty years of civil rights legislation into a weapon against the very marginalized people it was written to protect.

Trump administration exploits landmark civil rights act to fight schools’ diversity initiatives

"Linda McMahon, the education secretary, has described the investigation as part of the administration’s effort to “reorient civil rights enforcement to ensure all students are protected from illegal discrimination”. But civil rights advocates have denounced them as vague, likely unlawful and a betrayal of the spirit of the civil rights protections they purport to invoke.

“What we’re witnessing is an administration that is working very hard to turn civil rights laws against” the people trying to faithfully implement them, said Maya Wiley, the president of the Leadership Conference on Civil and Human Rights. “It’s really an effort to say, ‘If you don’t do what we tell you, we will turn our considerable power against you’.”

I think the facts here pretty much speak for themselves; weaponizing Title VI and IX of the 1964 Civil Rights act to fight bogus "anti-white discrimination," seize control over educational institutions to protect a US-backed genocide in Gaza, and persecute trans (primarily women) people is a gross, fascist perversion of the entire purpose of those laws and I have no doubt that doing so actively delights the cracker nazis running the Trump administration. Forcing a white nationalist framework onto American life through the very same mechanisms that were installed to fight rampant white supremacy in our society is the ultimate fascist troll job, and the "how's my ass taste" aspect of this initiative is probably just as important to the regime as its actual efforts to create a de facto white ethnostate through these methods.

Furthermore, I think it goes without saying that using one single SCOTUS decision striking down affirmative action in college admissions, to argue that the government has a legal responsibility to enforce white nationalist policy over every aspect of American life and education, is a ridiculously broad, crassly dishonest interpretation of the law that should in no way be given credibility by anyone who isn't a fascist. This isn't Simon Says, the clearly stated purpose of the Civil Rights Act matters here too, and going full "the card says Moops" in response to this objectively disingenuous nazi bullshit is a cowardly failure of civic responsibility by the media, education institutes, and every part of the American establishment that isn't directly fighting Trump's inversion perversion of the Civil Rights Act.

Finally I'd like to point out that this is yet another example of the way Trump's entire fascist agenda amounts of "governance by nazi conspiracy theory." The entire basis of the administration's argument that they can, and need to use Civil Rights law to protect white, straight, Christian men, is rooted in fascist conspiracy theories about "reverse racism," "gender ideology," and "white genocide" - none of which are real, or actually happening in our society. This is a consistent pattern now in how Trump rules; the regime states fascist conspiracy theories as fact, acts on those conspiracy theories as if they were actual crises-level emergencies, and then seeks reprisal against anyone who opposes their attempts to govern as if these fascist conspiracy theories are true.

#Harvard professors sue #Trump administration over funding cut threats

"The Harvard chapter of the American Association of University Professors sued the Trump administration Friday over what they call an 'unlawful and unprecedented' attempt to use federal funding cuts to restrict #FreeSpeech.

"The #DepartmentOfEducation announced in late March that it would review $8.7 billion in federal grants and contacts given to Harvard, alleging that the school failed to prevent #antisemitic discrimination on campus.

"The Trump administration then unveiled a broad set of demands on April 4 the university must agree to in order to keep getting federal funding, including cutting all diversity, equity and inclusion programming, and modifying any programming and departments that 'fuel antisemitic harassment.' The administration gave Columbia University a similar set of demands in March, which the school agreed to.

"The lawsuit by the professors' group, filed in #Massachusetts federal court, alleges that the administration's federal funding review violates the #TitleVI of the #CivilRightsAct, which prohibits discrimination in programs that receive federal funds. The court filing says the law requires specific procedures to cut federal funds and that the Trump administration has not taken any of those steps.

"The group said in a press release that the administration's actions are in effort to create a chilling effect among universities and faculty to stop speech that the president does not like.

" 'Eliminating discrimination and protecting all students is important,' said Nikolas Bowie, a Harvard law professor and the secretary-treasurer of the school's #AAUP chapter, in a statement. 'But Trump is defying the Civil Rights Act, terrifying students, and illegally holding hostage grants for hospitals and scientific research so he can accomplish his real goal of punishing academics for our politics.'

"The lawsuit says that the actions by the administration have 'already caused severe and irreparable harm by halting #academic #research and #inquiry at Harvard.'

"This is the second suit that the Harvard AAUP chapter has filed against the Trump administration this year. The first was a joint suit with other chapters, including one from Columbia, over federal efforts to deport #MahmoudKhalil and students that engaged in #ProPalestinian #activism."
