Allahabad Hc: इलाहाबाद उच्च न्यायालय ने एक पति के खिलाफ उसकी पत्नी द्वारा दर्ज क्रूरता के मामले को खारिज कर दिया है, जिसमें कहा गया था कि विवाद दंपति की “यौन असंगति” से उत्पन्न हुआ था। इस मामले में पत्नी ने आरोप लगाया गया था कि पति ने दहेज की मांग की, उसे प्रताड़ित किया और अप्राकृतिक यौन क्रियाकलाप किए। इस पर न्यायालय ने कहा कि एफआईआर और पीड़िता के बयान की बारीकी से जांच करने पर पता चलता है कि अगर कोई अत्याचार या हमला हुआ है, तो वह दहेज की मांग के लिए नहीं बल्कि आवेदक नंबर 1 (पति) की यौन इच्छाओं को पूरा करने से विपक्षी नंबर 3 (पत्नी) के इनकार के कारण हुआ है।”
मामला क्या है
इस जोड़े की शादी 2015 में हुई थी, जिसके बाद पति और उसके परिवार ने कथित तौर पर महिला से दहेज की मांग की। उसने आरोप लगाया कि दहेज की मांग पूरी न होने पर उसके साथ दुर्व्यवहार किया गया और मारपीट की गई। पत्नी ने यह भी कहा कि उसका पति शराब का आदी था और उसने उससे अप्राकृतिक सेक्स की मांग की थी। उसने आरोप लगाया कि वह अक्सर पोर्न फिल्में देखता था और उसके सामने नग्न होकर घूमता था और हस्तमैथुन करता था। जब उसने इस तरह की हरकतों का विरोध किया, तो उसके पति ने कथित तौर पर उसका गला घोंटने की कोशिश की।
उसने दावा किया कि उसका पति उसे उसके ससुराल वालों के पास छोड़कर सिंगापुर चला गया। आठ महीने बाद, जब वह सिंगापुर गई, तो उसके पति ने उसे फिर से प्रताड़ित किया। पति और उसके परिवार के सदस्यों के खिलाफ भारतीय दंड संहिता, 1860 की धारा 498ए, 323, 504, 506, 509 और दहेज निषेध अधिनियम, 1961 की धारा 3 और 4 के तहत मामला दर्ज किया गया। इसके बाद पीड़ित पति और ससुराल वालों ने उच्च न्यायालय के समक्ष केस निरस्तीकरण याचिका दायर की।
क्या कहा कोर्ट ने
न्यायालय का मानना था कि पत्नी ने अपने पति और ससुराल वालों द्वारा प्रताड़ित किए जाने के सामान्य और अस्पष्ट आरोप लगाए हैं। कोर्ट ने मामले को रद करते हुए कहा : किसी भी घटना में, विपक्षी पक्ष को कभी कोई चोट नहीं पहुंची है। इस प्रकार मामले के तथ्यों से, इस न्यायालय की सुविचारित राय में, किसी भी तरह से यह नहीं कहा जा सकता कि यह भारतीय दंड संहिता की धारा 498-ए के तहत क्रूरता का अपराध है। सामान्य और अस्पष्ट आरोपों को छोड़कर किसी भी विशिष्ट व्यक्ति द्वारा दहेज की किसी विशेष मांग के संबंध में कोई कथन नहीं है।
