"'The Government will promote high-quality, evidence-based impact assessment and consideration of regulatory options in law-making'.

This is how Petteri Orpo's (Coalition Party) government proclaims its principles for preparing legislation on page eight of its Strong and Caring Finland programme.

However, the government seems to have already ignored the principles it printed in June, when the budget laws related to social security cuts have been prepared at a rapid pace.

During September, the Chancellor of Justice, Tuomas Pöysti, has repeatedly pointed out that the assessment of both the individual cuts and their combined impact is flawed.

For example, the Chancellor of Justice says that the cuts in housing benefit do not indicate how much they might increase the number of people in need of income support.In particular, Pöysti says that there has been very little assessment of the basic and human rights of housing benefit recipients and their family members.

Pöysti has also pointed out that there is a problem that the alternative means of freezing index increases were not sufficiently assessed. According to Pöysti, this is particularly important from the point of view of the increase in poverty among families with children that is evident in the draft proposal.

On Tuesday, the Chancellor of Justice also pointed to the spirit of consultation of experts. The shortest time available has been only five working days. Expert opinions and impact assessments overlap, because without expert assessments it is difficult to see the impact, and vice versa.The preparation of the government's draft legislation has not been of high quality, says Professor Anssi Keinänen of the University of Eastern Finland.

"This is a clear example of how things have not gone as they should," says Keinänen.

Keinänen is a professor of legislative research and empirical legal research. He stresses that impact assessments are a measure of quality lawmaking.

They ensure that when MPs pass laws, they do so on the basis of informed decision-making, i.e. they understand what they are deciding.

"When impact assessments are inadequate and the overall impact is not presented, it is difficult for parliament to make informed decisions. Now, quality lawmaking is not happening." Keinänen says.According to Keinänen, Parliament's right to information is also not respected. Parliament's right to information is guaranteed by the Constitution.

Keinänen stresses that, ultimately, it is not just about MPs, but about open civil debate.

"On the one hand, it is also about the possibility for stakeholders and citizens to monitor political decision-making. In the current situation, this is missing."

The rush is partly due to the fact that if the laws are to enter into force in the timeframe the government wants, starting next year, they must be before parliament by 9 October.

It is up to each government to make the timetable as ambitious as it wants.

"But what is (problematic) is that a good legislative drafting process cannot be followed," Keinänen says.

The Ministry of Social Affairs and Employment is seeking comments on a draft law aimed at simplifying unemployment protection and increasing employment. The proposed changes would concern the employment condition of an employee, the mediation of unemployment benefits, the starting date of unemployment benefit entitlement and the child supplements to unemployment benefits.Unemployment allowance is available if you meet the employment condition. Currently, the condition of working is measured in calendar weeks. The proposal is that the employment condition should henceforth be determined on the basis of income from paid employment. This change would mean that only the wage income paid during a calendar month would be relevant for the purposes of accrual of the working time condition. The length of the condition of employment would be extended from the current one, and 12 months of employment would be required to fulfil the condition. A month of employment would be defined as a calendar month during which the income before withholding tax paid would be at least €930 per month. The working time could also be accumulated in half-months.

The provisions on the daily subsistence allowance would be amended to reflect the changes to the working conditions. These changes would bring the earnings-related allowance more into line with the person's income level at the start of unemployment.The proposal is to abolish the protective component of the unemployment benefit arrangement. The "safety margin" refers to the part of income that is not taken into account when calculating the amount of unemployment benefit that is adjusted. At present, the protection component is €300 for one month of conciliation and €279 for four consecutive calendar weeks of conciliation.

Entitlement to unemployment benefit would henceforth start after a deductible period of seven days of unemployment. In addition, the payment of holiday pay at the end of a full-time job lasting more than two weeks would prevent the payment of unemployment benefit for the period over which the holiday pay is spread. Holiday pay is divided by the average daily wage for paid work.

The draft law is to abolish child supplements to unemployment benefit. The abolition of the increments will lead to changes in the amount of the mobility allowance and in certain provisions on the financing of unemployment benefits. The abolition of child supplements will also have an impact on maintenance payments and the financing of maintenance payments, as the child supplement to unemployment benefit has been used to pay maintenance payments in situations where the parent liable for maintenance is unable to pay maintenance.

The changes to remove the protection component of the unemployment benefit and the child element of the benefit would increase the similarity of unemployment benefits with other income support benefits.The changes are designed to simplify the unemployment benefit system.
In line with the government programme, the proposed measures aim to simplify and clarify the unemployment benefit system, increase employment by improving incentives to work and strengthen public finances.

The measures in the proposal aim at an expenditure adjustment of around €250 million and an increase in employment of around 20 000 people. The increase in employment generated by the changes is estimated to strengthen public finances by around €550 million.

The proposal is part of the government's 2024 draft budget and is intended to be considered in conjunction with it.

The Act is intended to enter into force on 1 January 2024, with a staggered application of the changes. From the date of entry into force, the changes concerning the extension of the deductible period and the impact of the holiday allowance would apply. From the beginning of April, the changes concerning the abolition of the child supplement and the abolition of the protection component of the conciliation would apply. The changes to the employment condition would apply from 2.9.2024
