Der Europäische Gerichtshof (EuGH) hat entschieden, dass Internetanbieter IP-Adressen speichern dürfen, um auch bei geringfügigen Straftaten wie Urheberrechtsverletzungen Nutzer identifizieren zu können – solange diese Daten getrennt von anderen personenbezogenen Informationen gespeichert werden. Diese Entscheidung rettet das französische #HADOPI-System, das bei Urheberrechtsverstößen schrittweise Verwarnungen ausspricht. Die technische Bedingung: IP-Adressen dürfen nur in einem geschlossenen System mit begrenztem Zugriff gespeichert werden. Zwar schafft das Urteil neue Spielräume für die #Vorratsdatenspeicherung in der EU, wirft aber auch viele Fragen auf – etwa zur Zulässigkeit des Zugriffs ohne richterliche Kontrolle und zur Übertragbarkeit auf andere Ermittlungsbereiche. Die langfristigen Auswirkungen auf #Datenschutz und Strafverfolgung in #Europa bleiben unklar.

Suite à une décision de la justice européenne, les services de la rue de Valois réclament du temps pour engager la modification de la loi sur le partage libre et non marchant Hadopi.

C’est un contentieux vieux de maintenant 5 ans. En 2019, quatre associations - la Quadrature du Net #LQDN, la Fédération des fournisseurs d’accès à Internet associatifs #FFDN et French Data network #FDN - s’étaient attaquées au cœur de la riposte graduée, à savoir le décret d’application de la fameuse loi Hadopi.

La cour de justice de l’Union européenne vient de rendre un arrêt expliquant qu’une « autorité publique nationale chargée de la lutte contre les contrefaçons commises en ligne peut accéder à des données d’identification à partir d’une adresse IP ». Cette décision fait suite à une saisie du Conseil constitutionnel par quatre associations, dont la Quadrature du Net.
