How Procedure Upended Personal Liberty In Allahabad High Court’s Refusal To Protect Interfaith Couples
In January 2024, the Allahabad High Court turned down appeals of nine interfaith couples for protection from their families on the grounds that they did not solemnise their marriages according to Uttar Pradesh’s anti-conversion law. In doing so, the High Court opted for procedure over liberty, even as challenges to the law are pending in the Supreme Court, which last heard the case in April 2023.

#Tennessee has passed a state law which effectively guts the #MarriageEqualityAct.
This is being sold to voters as a way to not force #CountyClerks & other officials to obey the law of the land, and allow them to practice their misguided beliefs. The problem is, #marriages CANNOT be legal without the signature of these officials.
It will also allow officials to discriminate against #InterracialMarriages and #InterfaithMarriages.
Their firm knowledge that the current #Conservative #SCOTUS bench will almost certainly refuse to uphold the #Constitution and existing laws, in favor of their own #bigoted ideology, is really emboldening the #KKK and other #GOP voters there.

Several Indian states have enacted laws to curb interfaith marriage, and Delhi-based non-profit Dhanak Of Humanity, which has helped over 5,000 couples of different faiths, castes and communities over a decade, says these laws could criminalise those aiding such couples. Co-founder Asif Iqbal told us the government and groups campaigning against the ‘love jihad’ trope do not want unions under a law that allows them to be married, while many states have not obeyed a 2018 Supreme Court order to set up a helpline and shelter homes for couples in love at risk of honour killings, violence by communal groups.
