Diesen Anforderungen hat das Bundesamt vorliegend nicht genügt. Die sachliche Fest-
stellung im Bescheid vom 23.05.2024, nach den Erkenntnissen des Bundesamtes gelte
der Antragsteller seit dem 01.08.2022 als untergetaucht, da weder dem Bundesamt
noch der Ausländerbehörde der derzeitige Aufenthaltsort des Antragstellers bekannt sei,
und die rechtliche Bewertung, es werde daher gemäß § 33 Abs. 2 Satz 1 Nr. 2 AsylG
vermutet, dass er das Verfahren nicht betreibe (Seite 2 des Bescheides), beruhen aus-
weislich der beigezogenen Akte des Bundesamtes allein auf der Mitteilung vom
22.05.2024, wonach „folgender Meldestatus ‚Fortzug nach unbekannt‘ von der Behörde
OB Frankfurt am Main (Behördenkennzeichen 030400) am 2024-05-22 gemeldet am:
2022-08-01“ mitgeteilt wurde (Blatt 412 der Behördenakte). Auf welcher Tatsachen-
grundlage diese Mitteilung ihrerseits beruht, ist nicht erkennbar. Weitere – hier gebote-
ne – Nachforschungen hat das Bundesamt weder ausweislich der Behördenakte veran-
lasst noch im Laufe des gerichtlichen Eilverfahrens behauptet. Jedenfalls hätte die An-
tragsgegnerin, nachdem ihr das Bestehen einer Bevollmächtigung aus dem vorange-
gangenen Gerichtsverfahren vor dem Verwaltungsgericht Gießen (siehe oben) hätte
bekannt sein müssen, zunächst bei dem Bevollmächtigten des Antragstellers Erkundi-
gungen nach dessen Aufenthaltsort einholen müssen, bevor sie das Verfahren mit der
Begründung, der Antragsteller sei untergetaucht, einstellt.
