#EagleLakeFirstNation challenges #NWMO in court

EAGLE LAKE – "#EagleLake #FirstNation is challenging the #NuclearWasteManagementOrganization’s site selection in court, and that’s more than welcome news to Neecha Dupuis.

"'I love it,' Dupuis, a member of the #Ojibway Nation of #Saugeen (#SavantLake), said from Ottawa. 'Just pure love.'

"Eagle Lake’s chief 'came and walked with us' in this year’s #WalkAgainstNuclearWaste, she noted.

"'It’s all coming together, like one giant dream catcher,' Dupuis said.

"Dupuis said she doesn’t understand #WabigoonLakeOjibway Nation’s decision to move forward with the NWMO on possibly constructing a deep geological repository, or DGR, for high-level nuclear waste.

"'For them to choose nuclear waste over the land, that doesn’t make sense. It doesn’t make sense at all.'"

Ontario's top court has upheld a lower court's ruling that a strip of #SaubleBeach, a popular Ontario tourist spot, has always belonged to a local #FirstNation.

In a 121-page decision on Monday, the Ontario Court of Appeal dismissed appeals brought by the Municipality of South #BrucePeninsula, the Ontario government, and several local families to the April 2023 ruling by Superior Court Justice Susan Vella.

"Justice was done today," said Saugeen First Nation Chief Conrad Ritchie in a statement, calling it a "powerful moment" for the Saugeen community.

In her 2023 decision, Vella ruled that "Chi-Cmiinh," a roughly two-kilometre strip of beach at the northern end of Saugeen Reserve No. 29, had always belonged to Chippewas of Saugeen First Nation, and that the federal government breached its treaty rights.

The Crown, Vella wrote, failed to protect and preserve the #treaty it signed in 1854, Treaty 72, in which the First Nation and neighbouring #Chippewas of Nawash surrendered Saugeen Peninsula, excluding five #Indigenous reserve territories. One would become #ReserveNo29.

Moving nuclear waste through traditional territories could face opposition, #Ontario First Nation says

'Think about how many treaty territories that waste would have to go through,' chief says

"A First Nation in southwestern Ontario says even if the community votes yes on a proposed $26 billion dump for #NuclearWaste within their traditional territory, it would likely be opposed by other #FirstNations, through whose territories the more than 5.5 million spent fuel rods would have to pass.

"#Canada's nuclear industry has been on a decades-long quest to find a permanent home for tens of thousands of tonnes of highly radioactive waste. The search has narrowed to two Ontario communities — #Ignace, northwest of #ThunderBay, and the Municipality of #SouthBruce, north of London.

"Both will vote later this year on whether to build a deep geologic repository, a kind of nuclear crypt, where more than 50,000 tonnes of waste in copper casks will be lowered more than 500 metres underground to be kept for all time, behind layers of clay, concrete and the ancient bedrock itself.

"But so will their Indigenous neighbours, whose traditional territories the towns are within, which gives each respective First Nation a veto.

"In the case of Saugeen Ojibway Nation in particular, it means the community again finds itself as the future arbiter of a potential nuclear waste site on their traditional lands for the second time in a few years."
