#ICE Secretly Hauled #MahmoudKhalil to #Louisiana as Retaliation, Lawyers Allege

By moving the campus #activist to a new jurisdiction, ICE disrupted court proceedings and limited his legal access, his attorneys say.

"Mahmoud Khalil’s wife watched as agents from the Department of Homeland Security handcuffed her husband and whisked him away from their New York City apartment in an unmarked vehicle on Saturday evening.
Agents ignored the pleas of Khalil’s wife who tried to show them legal papers proving her husband was a green card holder. They wouldn’t heed her requests to share where they were taking him, according to court filings. Eventually, one of the agents offered a terse response: Check the local immigration court at 26 Federal Plaza in Manhattan.

"By next morning, however, the Immigration and Customs Enforcement detainee locator indicated Khalil was no longer in New York. Instead, it showed him at the Elizabeth Detention Center in New Jersey. When Khalil’s wife visited the jail, she was turned away.

"Without warning to Khalil’s wife or his immigration attorney Amy Greer, who the same morning had filed a petition to challenge her client’s arrest as a violation of his First Amendment free speech rights, ICE agents had transferred Khalil to a different facility. This time, they moved him thousands of miles south of his New York home to a facility in Louisiana. It wasn’t until Monday morning that Khalil’s exact whereabouts were updated in the ICE online system: the #LaSalleDetentionFacility in #JenaLouisiana, a #PrivateJail operated by the #GEOGroup.

"Attorneys for Khalil allege the move from the New York metropolitan area to Louisiana was a '#RetaliatoryTransfer' intended to restrict his access and to lawyers and family, and position what has grown into a closely watched #FirstAmendment case in a jurisdiction more friendly to the Trump administration’s anti-immigrant policies.

"Three days after his detention, Khalil still has not been charged with a crime. The Department of Homeland Security has said it arrested Khalil, a lead negotiator for Palestine solidarity protesters at Columbia, for having “led activities aligned to Hamas.” President Donald Trump, who campaigned on deporting pro-Palestinian protesters, pledged that Khalil’s arrest is 'the first arrest of many to come' and that his administration would continue to target for deportations 'more students at Columbia and other Universities across the Country who have engaged in pro-terrorist, anti-Semitic, anti-American activity.'

"Although a Manhattan federal court ordered a temporary halt preventing the Trump administration from immediately deporting Khalil, attorneys remain concerned for his well-being and ability to access proper legal counsel. In a motion filed Monday evening by attorneys from the Center for Constitutional Rights and the Creating Law Enforcement Accountability and Responsibility project at the City University of New York School of Law, attorneys seek to reverse the ICE decision and to transfer Khalil back to New York."

"One of the purposes of 'flooding the zone,' as the Trump regime is trying to do — shocking and awing us with its blitzkrieg of bonkers orders — is to make it almost impossible to sort out what we should be incredibly freaked out about from what we should merely freak out about.

"I’m incredibly freaked out about the regime grabbing people from their homes who are legally in the United States, with permanent status — not just visas permitting them to work or study here but green cards — and then whisking them away to prison because they’ve engaged in constitutionally protected speech that the regime doesn’t like.

"You think I’m exaggerating? This is exactly what happened to #MahmoudKhalil on Saturday night. Khalil, who graduated from #Columbia’s School of International and Public Affairs in December, has a green card. His wife, who is eight months pregnant, is an American citizen.

"Immigration agents appeared at his apartment building and told him he was being detained. He now appears to be in a detention facility in Louisiana.

"Khalil did nothing illegal. He has not been charged with a crime. He expressed his political point of view — peacefully, non-violently, non-threateningly. That’s supposed to be permitted — dare I say even encouraged? — in a #democracy.

"So why is he in jail?

"#Khalil was one of the leaders of last year’s peaceful pro-#Palestinian #protests at #ColumbiaUniversity.

"In a post on Truth Social, Trump conceded Khalil was snatched up and sent off because of his politics. 'This is the first arrest of many to come,' wrote Trump. 'We know there are more students at Columbia and other Universities across the Country who have engaged in pro-terrorist, anti-Semitic, anti-American activity, and the Trump Administration will not tolerate it.'"

When ‘Shock and Awe’ Turns Into ‘Aw Shit’

Shock and Awe! Shock and Awe! Yes, we’re all shocked but I think there’s more of an “Aw Shit” response than there is any real ‘awe.’ At least I hope so. If that’s not the reaction, then you’ve been holed up like a groundhog or in some fantasy of your own creation for far too long.

Of course I’m referring to all of the insane stunts that are happening during these early days of the end of the American Experiment. Don’t blowback on the use of the word “stunts.” People get hurt doing stunt work all the time. Some have died. Both are going to happen at some point in our future.

But make no mistake, these “shock and awe” stunts are literally intended to do real harm while overwhelming any attempt to impede them. It’s designed to create chaos. Sadly, it’s working.

To say the Democrats are in disarray is to spit out a bad cliché like a rotten sunflower seed. To say whatever used to be the GOP has surrendered everything except their daughters to Trump is also old news. That last part might also be premature. To say the fourth estate is complicit misses the point completely. Ask yourself where the cameras were during all of Elon Musk’s frat boy takeovers this weekend. Perhaps if a plane had crashed into the Treasury building they would have been there. To say the oligarchs and tech bros are the real winners is watching a trailer for a comedy action thriller that leaves out the spoiler in which everybody dies in the end.

Josh Marshall has two good pieces about this that are worth reading here and here. They both reveal that we’re cascading down a series of rapids, without a paddle, heading towards a waterfall without a life preserver. One line stands out “The point is that you do ‘shock and awe’ when you don’t actually have the power to pull the job off.” He’s mostly correct there, leaving out only the important part about also having the smarts.

Just remember how shocked and awed we were when the bombs dropped in Baghdad. Also remember how much of a shit show we turned that into.
