EVIDENCE EXISTS APLENTY THAT DONALD TRUMP AND GESTAPOPUBLICANS TRY TO DISENFRANCHISE VOTERS, ARREST AND EVEN DEPORT PEOPLE BASED SOLELY ON THEIR OWN PARANOID SUSPICIONS - NO DUE PROCESS - SOLELY ON SUSPICION

The United States currently has an elected president and an unelected billionaire who are flagrantly breaking its laws. As members of Congress wrongly insist they have no leverage to do anything about this, we who care about democracy are pleading for others to help. Is it consistent with democracy to direct these pleas to the federal judiciary—a branch of government staffed by unelected judges?

Yes, of course. With reservations.
Argues that while courts are powerful, there are significant downsides to leaning on them in this instance:
A third downside to relying on the judicial menu is that federal courts helped get us into this mess—and they can make things much worse by ratifying the lawbreaking. Few federal judges believe it is actually their democratic responsibility to enforce the laws passed by Congress; most of them believe they can disregard any law whose constitutionality they disagree with.

Signs of Hope…
“…the GOP wants to portray Trump as an all-powerful president imposing his will on a fearful and dispirited govt.…

“However,…[t]he reality is that govt workers are standing up. And he is losing most of the lawsuits challenging his illegal actions. Plaintiffs, their lawyers & federal judges are not backing down. Instead, they are upholding the rule of law.”—#MarcElias, #democracydocket members’ email, 03/01/25

@RiaResists federal judges are appointed for their lifetimes to try to help assure their judicial independence.

So they don’t run for elections and don’t directly answer to the electorate.

Looking into filing an amicus brief is likely the best way to try to tell the court what the impacts of the case may be beyond the parties in the case itself.

What Are Amicus Briefs?
An amicus curiae is a person who isn’t a party to a case. They assist an appellate court by offering additional, relevant information or arguments the court may want to consider before making their ruling. The phrase, amicus curiae, is Latin for “friend of the court.” Amicus briefs – shorthand for the formal term “amicus curiae briefs,” are legal briefs filed in appellate courts by amicus curiae. They are submitted in a specific case under review. They essentially show the court that its final decision will impact people other than the parties.

Amicus briefs are filed by people who typically take the position of one side in a case, in the process supporting a cause that has some bearing on the issues in the case. The groups most likely to file amicus briefs are businesses, academics, government entities, non-profits and trade associations.

Actually, we know that it's far too many judges who feel this way, and the system favors them.

This is how so many Black people get harsh sentences for minor crimes, and more.

Uncageable

From the light of freedom to a concrete tomb,
The fall was great and swift.
My soul cried out in a mighty boom,
How could it come to this?

Clamped down, trapped stuck,
Paralyzed in a tiny cage.
Had fate left me not a drop of luck?
Was there reason for this rage?

Told to lay down and die,
Something deep inside me stirred.
I can’t be caged I have to fly!
Not yet am I interred.

They can take my body, tie me down,
It matters not a bit.
My spirit still runs wild and free,
So in freedom here I sit.

Hand drawn image of a man interred in prison. He is kneeling in his cell between the bunk and desk cabinet, envisioning a scene above his head of a couple holding hands and giving thanks over food and a crowd seated together and a couple in the distance holding hands.

Imma read Cannon's ruling tonight, and reserve judgment until I do so. One thing I've learned is that very few TV lawyers provide cogent explanations and there aren't that many writing online that do either. There are some online, but "this guy used to be a prosecutor and now posts viral tweets so he knows" aren't usually reliable for me.

UNREAL legal development upends 2024 election
Brian Tyler Cohen

"Unreal" is the word. Week after week, Brian Tyler Cohen and Marc Elias put out these vital and highly valuable discussions about the fight for voting rights. These talks are about really slow moving processes and, thus, they may not seem anywhere near as interesting as other things going on, such as Donald Trump's crookery; but they have everything to do with the kind of country we are going to be living in. So, I strongly suggest watching this video and the others in the "Democracy Watch" series. We are either going to win these fights or we are all going to sink into the Bog of Eternal Stench.
