We have released an initial study on Acadia Pharmaceuticals ($ACAD) patent US 11370755 covering the drug Daybue®.
It is one of the strangest patents we have ever examined.

The pharmaceutical industry gutted research and development of new drugs. They got rid of all of many parts of that process that they could contract out or buy from others. What they were left with were drug monopolies and that really changed how they behaved.
Today, by and large, the pharmaceutical industry does little to research and develop drugs. They buy up other companies that have done that research, often with huge amounts of taxpayer funding. As a consequence, if you are a company that profits primarily from intellectual property, what’s important to you is not doctors and medical researchers but lobbyists and lawyers, because they are the people who are going to extend and deepen your patents.
You have no interest in medicines that would treat diseases primarily suffered by poor people in poor countries; you have no interest in dealing with pathogens that could cause the next pandemic, because in all likelihood, a pandemic won’t be caused by that specific pathogen. They have very little interest in curing disease, because their ultimate blockbuster is lifelong treatment for chronic disease — that’s where enormous amounts of their time and energy are spent."

In a precedential opinion the CAFC upheld the rights of generic manufacturers to carve out methods of use on patented drugs saying “a brand could ‘maintain its exclusivity merely by regularly filing a new patent application claiming a narrow method of use not covered by its NDA,’ which ‘would confer substantial additional rights on" the #pharmaceutical company.
This is a significant holding against patent evergreening by #bigpharma.

ICER has released its 'Unsupported Price Increase Report' for 2023.
Inside is a list of the 250 drugs with the largest sales revenues for 2022. Useful in and of itself.
However, they list 8 drugs (Humira, Darzalex, Ibrance, Prolia, Xifaxan, Xegeva, Perjeta, Adcentris) where pricing increases were significant but not supported by new clinical evidence.

As a follow-up to our original post concerning delisting of certain Orange Book patents, on 2/24/23 the Federal Circuit affirmed an earlier district court decision that a REMS patent issued to Jazz Pharma failed “to claim a drug or method of use" and U.S. Patent 8,731,963 should be delisted.

Letter from Sens Warren & Sanders and Reps Porter & Jayapal to Dir. Vidal at USPTO urging review of Merck's attempt to extend patent protection on Keytruda.
"These efforts by Merck appear to be part of a long-standing pattern of drug manufacturers’ abuse of the patent system."
Merck's has "filed 129 patents linked to Keytruda which could extend the period of exclusivity ... nearly a decade past its expected end date."
Cornyn, Blumenthal Introduce Bill to Lower Drug Costs by Preventing Patent System Abuse
“The pharmaceutical industry’s shameless abuse of the patent system has driven costs sky-high for consumers by keeping generics off the market and stifling innovation,” said Sen. Blumenthal.
Much needed reform to prevent product hopping and repeated assertions of different patents for producers of biologics.
Let's hope this has some teeth.
