Despite his family’s trauma, the army detention of a 33-year old with no criminal record from his home on a freezing night in December 2022 was legal, since the military has had sweeping powers to arrest or shoot terror suspects in Kashmir for 32 years. But what followed, from the accounts of the family, local police and sarpanch—and the interpretation of India’s law for ‘disturbed areas’ by two retired generals—was a violation of that law and the army’s own procedures, as Abdul Rashid Dar became the latest of more than 8,000 Kashmiris to disappear since the 1990s.
