SCOTUS has what I see as the unstated but practical power of Supreme Jury Nullification.
They can, like Trump, identify certain otherwise questionable actions as legal by saying, basically, if this comes to us, we will not uphold standing law that would seem to prohibit those actions.
So, for example, Trump CAN order the Army to attack the civilian population. This might create great turmoil within the Army, but fear that objecting would be seen as treasonous. It seems to me (not a lawyer, just a citizen) that SCOTUS could simply say something like "In the present situation, we realize it likely that POTUS will order such action, but we feel that action is unlawful, so anyone in the rank and file military who stands up and says they will not do it will not be seen by us as traitorous."
It will be bad if it comes to that. But it seems a power equal to that of POTUS. And, as things fall apart, it feels like an option.
It's also not one of those things that the Supreme Court usually does. They tend to respond to questions more than rule pro-actively. But, there have been extreme cases where they have invented the need to do otherwise (Marbury v. Madison and Bush v. Gore come to mind) based on either gap-filling or some kind of urgency. Advisory rulings are not their typical fare, and are a risk, yet they are the ultimate gatekeepers of what is right and proper.
