In a much-criticized opinion in September, justice #Brett #Kavenaugh supported the Trump administration’s campaign of
💥randomly stopping Hispanics on the street in an effort to root out undocumented immigrants.

At the time he wrote,
“Immigration stops based on reasonable suspicion of illegal presence have been an important component of U.S. immigration enforcement for decades,”
👉 before allowing that
“apparent ethnicity” could be a “relevant factor” for demand of proof of citizenship.

He also suggested that any questioning is “typically brief”
and U.S. citizens and legal residents would
“promptly go free.”

That opinion gave rise to what is now called a ⚠️“Kavanaugh stop”
— coined by Drexel Kline School of Law Professor Anil Kalhan.

According to the two Slate analysts,
Kavanaugh now opining in a recent footnote,
“that race and ethnicity could not be ‘considerations’ when officers make
‘immigration stops or arrests,’”
is a stab at cleaning his already troubled legacy.

⭐️“I think he is begging us to please cease and desist calling them ‘Kavanaugh stops.’

This footnote is buried in the opinion and doesn’t really have anything to do with it.

He just says:
By the way, this conflict is about immigration stops,” Stern offered.

“Wow! Immigration stops can’t be based on race?
What a concept!”
Lithwick sarcastically added.

Back then, you wrote that immigration stops could be at least partly based on race or ethnicity,
and that a person’s appearance as Latino could be one reason for them to be stopped by immigration officers.”

“I think he is trying to rid 'Kavanaugh stops' from the discourse,
which is never going to happen.

And maybe he’s trying to send a message to the Trump administration to cool it down,”
Stern suggested

Stern then added, “Every intelligent observer understood what was going to happen when his opinion dropped in September.

Now he seems to regret it

or acknowledged that he was wrong,
and is pretending that what he said earlier is consonant with what he’s saying now.

I know that regulation in the #USA are pretty lax and "judge" #Kavenaugh is fighting hard to make 'em even more, but how in the hell did the deathtrap of a rusty knife on wheels called #Tesla #Cybertruck #TeslaCybertruck pass any kind of safety regulation? Are #trucks exempt from ALL #regulation in #America?

Supreme Court agrees to rule soon on whether Trump is barred from running for president

The Supreme Court announced Friday that it will decide on a fast-track basis whether former President Trump can be barred from the 2024 ballot because he “engaged in insurrection” after losing his reelection bid in November 2020.

The justices granted an appeal from Trump and his lawyers that seeks to overturn a Colorado Supreme Court decision that would remove Trump from that state’s ballot.

The court said it would hear arguments on the case on Feb. 8.

The supreme court is dominated 6-3 by rightwingers who have delivered historic rulings including removing the federal right to abortion.

It includes three justices installed when Trump was president.

On Thursday, a Trump lawyer, Alina Habba, caused controversy when she told Fox News one such appointee, Brett Kavanaugh, would now “step up” for the man who put him on the court.

Controversy also surrounds Clarence Thomas, the longest-serving justice whose wife, the rightwing activist Ginni Thomas, was involved in Trump’s election subversion.

On Friday, Christina Harvey, executive director of the progressive advocacy group Stand Up America, said Thomas should not take part in the Colorado case.

“The American people deserve a fair and impartial review … free from any conflicts of interest,” Harvey said.

“Justice Thomas’s continued refusal to recuse himself from this case and others related to the efforts to overthrow the 2020 election … raises questions about the integrity of the judicial process and the influence of political bias.
