Business as Usual was how Genocide, War Crimes, Crimes of Aggression and Crimes Against Humanity were made internationally illegal in the Treaty of the Rome Statute.

Nevertheless, as a democratic society, Israel has been conducting ongoing political, pand academic debates concerning the ICC and its significance in the context of international law and the international community. The Court’s essentiality - as a vital means of ensuring that criminals who commit genuinely heinous crimes will be duly brought to justice, while other potential offenders of the fundamental principles of humanity and the dictates of public conscience will be properly deterred - has never seized to guide us. Israel’s signature of the Rome Statute will, therefore, enable it to morally identify with this basic idea, underlying the establishment of the Court.

If Iran ever ratifies the #RomeStatute (following the current uprising?), then some of these might qualify for trial in TheHague by the #InternationalCriminalCourt (though the ICC will try to go as high up the chain as it can, per the evidence + chance of a conviction for #CrimesAgainstHumanity ). The #ICC is investigating thousands of war crimes cases in Ukraine, even though Ukraine didn't sign the #RomeStatute, because Ukraine invited them in.

We could do the same here: dislodge the fascists and have the next President invite them in to investigate crimes against humanity.

Recently I got to talk to a #Democratic Party leader.

I used the moment to talk about how the #InternationalCriminalCourt can be invited to take jurisdiction within U.S. borders, to investigate and prosecute crimes against humanity. Ukraine, which like the U.S. did not sign the #RomeStatute (the treating creating the #ICC), has done this to allow the ICC to investigate Russian war crimes in Ukraine.

I let them know this is the minimum I expect from a 2028 Democratic presidential candidate.

The #InternationalCriminalCourt doesn't have jurisdiction inside the U.S. because the U.S. didn't sign the #RomeStatute.

But that's not the end of it. A non-signatory country can invite the #ICC to take jurisdiction within its borders, as Ukraine has done regarding Russian war crimes. That would also allow #Trump to be tried for #CrimesAgainstHumanity along with his collaborators, pardoned or not.

"(ii) Intentionally directing attacks against the civilian population as such or against individual civilians not taking direct part in hostilities;"

"(xxi) Committing outrages upon personal dignity, in particular humiliating and degrading treatment;"

Providing humanitarian aid to people subject to a famine is not "taking direct part in hostilities".
