o First, under US copyright law, anyone is free to use a character as it has been developed in public domain works, whether it is Winnie-the-Pooh, Sherlock Holmes, or Mickey Mouse (next year). If that character recurs in later works that are still under copyright, the rights only extend to the newly added material in those works, not the underlying material from the public domain works—that content remains freely available.

o Second, not all of the newly added material in the later works is copyrightable. In order to qualify for copyright, it must be “original, creative expression,” meaning that it was independently created (as opposed to copied from somewhere else) and possesses at least a modicum of creativity. Mere “ideas” such as generic character traits are not copyrightable. Nor are “merely trivial” variations added to the original character. In addition, using commonplace elements that have become standard or indispensable (copyright law calls these “scénes a faire”) is not infringement.

I need a cart to push my reading materials and coffee accoutrements from one end of my apartment to the other. That's how serious it's gotten.
