Squeamish About Bitcoin

First of all, Bitcoin is a non fungible token or NFT. Doesn’t that sound kind of icky to you? It does to me.

But we can forgive Bitcoin for that. Especially if the NFT keeps rising in value. Which it has done since Donald Trump has gotten elected.

For whatever reason, Donald Trump has chosen to support Bitcoin. This puts the president elect in a weird position. You see El Salvador made Bitcoin the official currency in 2021. By supporting this NFT, Donald Trump is in essence being made into a lackey of El Salvador.

I don’t like Bitcoin. Not because I believe that governments should have power over their currencies. But because Bitcoin is extremely expensive environmentally.

Bitcoin uses an excessive amount of electricity to work. At present day usage, which isn’t that much compared to how it could be used, it is already using as much electricity as the whole country of Greece. Imagine how much electricity it would use if it were used regularly by all Americans. Bitcoin is a bad deal for the environment. Other NFTs are working on this problem by possibly working differently. But it still isn’t ironed out. And Bitcoin has shown no indication of reforming.

Maybe it’s because of this shortcoming that Satoshi Nakamoto lies low. He is the inventor of Bitcoin. Or the supposed inventor of Bitcoin. No one knows if he is really a person or a group that started Bitcoin. There is enough Bitcoin under that name that he would be a billionaire if he revealed himself. But all that Bitcoin under the name hasn’t changed hands in many years.

Is Satoshi Nakamoto embarrassed by his creation? Is it the electricity usage? Or is he fearing retaliation by those invested in country currencies? No one knows. But the way he lies low may mean that Bitcoin is a bad investment.

The Associated Press to Launch an NFT Photography Marketplace

The Associated Press (AP) has announced that it will soon launch a non-fungible token (NFT) marketplace where "collectors" can purchase selections from its modern and historic library of photojournalism.

AP is building the marketplace in conjunction with blockchain provider Xooa and intends to launch the platform on January 31, and the collection will be released over a period of weeks. The organization says the initial collection that will be offered will feature photography by current and former AP photojournalists (including Pulitzer Prize-winning photos) as well as a selection of what it describes as "digitally enhanced depictions of their work."

AP dipped its toe into NFTs in May of 2021 when it launched 10 through a collaboration with Everipedia and OpenSea. Clearly, the organization saw that endeavor as a success as it has decided to dramatically increase its efforts in the crypto space.

“For 175 years AP’s photographers have recorded the world’s biggest stories through gripping and poignant images that continue to resonate today,” Dwayne Desaulniers, AP's director of blockchain and data licensing, says. “With Xooa’s technology, we are proud to offer these tokenized pieces to a fast-growing global audience of photography NFT collectors.”

AP says that each NFT will include the set of original metadata that it hopes will entice collectors who want to see the time, date, location, equipment, and technical settings used to create the photos. The content of the photography will range from space, climate, war, and other images that the organization says will put a spotlight on the work of specific AP photographers.

The storied press organization says that the prices it will seek for its NFts will vary, but that as a not-for-profit news cooperative, any funds it collects as the result of the sales will go back to funding "factual, unbiased AP journalism."

One major concern with NFTs has been their environmental impact, but the AP says its NFTs will be minted on the Polygon blockchain, which it claims is an "environmentally friendly, Ethereum-compatible layer two solution."

Of note, AP isn't just planning to mint and sell NFTs, but control the process through the custom marketplace. The organization says that its goal is to allow for collectors to buy, sell, and trade official AP digital collectibles through that marketplace and it will also support secondary market transactions and purchases using credit card payments as well as crypto wallets, including MetaMask, with support for Fortmatic, Binance, and Coinbase down the line.

The AP NFT marketplace will be called the AP Market and interested parties can join the waitlist to be notified when it officially launches.

As Theft Thrives, Artists Say OpenSea Does Little to Protect Copyrights

Some artists are reporting major issues with OpenSea, one of the largest non-fungible token (NFT) marketplaces. They say the company has an overly arduous process to report stolen art and is too slow to act once a complaint is filed.

NFTs are verified on a blockchain and thus add a sense of transparency when it comes to buying and selling digital artwork, but none of that matters to the artist if their work is stolen in the first place. Although it is not uncommon for artists to issue takedown notices across various NFT marketplaces, some Twitter users have pointed out that OpenSea has been particularly difficult to deal with when it comes to reporting the theft of art.

Twitter user NFT thefts has been collecting evidence from artists who have publicly tweeted about others impersonating them or selling their artwork without permission. In regards to OpenSea, two particular issues have surfaced: bots that upload stolen artwork and the slow processing of reacting to takedown notices.

OpenSea has a bot problem. We used to see plagiarized art appear more slowly on NFT marketplaces, but it looks like a huge wave of bots are now stealing artist's usernames, profile pics, bios, and art en masse to automatically populate fake NFT collections on OpenSea. <https://t.co/VgwpoORbRc>

One artist, Muffins & Stitches, has been filing numerous takedown notices for stolen art on OpenSea but has received poor support from the company. After submitting a ticket, OpenSea replied it "can take up to a week depending on the complexity of the issue."

No, really, @opensea is everything OK out there? Up to a week if someone is stealing art and selling it as NFTs on a knockoff-account?
Are you gonna issue remuneration if anything sells? Or take over the NFTs and forward them to real artists? pic.twitter.com/I9e40oN2Mi

— Muffins & Stitches (@BlindHag) December 15, 2021

"Up to a week if someone is stealing art and selling it as NFTs on a knockoff-account?" Muffins & Stitches tweeted in response. "Are you gonna issue remuneration if anything sells? Or take over the NFTs and forward them to real artists?"

Another Twitter user, Jon Neimeister, has taken the matter into his own hands and asked artists to get in touch if they have had their work stolen and minted as NFT. He explains he will "research and organize legal action against these platforms profiting off stolen work."

Are you an artist who has had your work stolen and minted as an NFT? Please gather your receipts and send them to CirenSongOfficial at Gmail - over the coming months I am going to research and organize legal action against these platforms profiting off stolen work.

— Jon Neimeister (@CirenSong) December 9, 2021

In the Twitter thread, he says that this issue has affected him and his colleagues directly and that he also submitted a claim to OpenSea for stolen work. In response to his claim, OpenSea sent a list of requirements that must be met before OpenSea will even begin an investigation.

.@opensea just responded to my ticket of my own stolen work saying I must meet the requirements below to take down stolen work. It is not the responsibility of artists to spend 3 hours a day filing formal documents proving they own their own work. It's time for this to end. pic.twitter.com/pJq31RjYHg

— Jon Neimeister (@CirenSong) December 15, 2021

Another user highlights that in order to file the request, anyone reporting stolen work has to reveal personal information, such as legal name and address, which is then forwarded to the person selling the stolen assets. This could equip the scammer with sensitive information that could be misused further.

Yo, encountered same theft regarding my own old art!

What I really disliked about filing their DMCA notice is that they provide literally all of your personal data including legal name and legal address straight to the offender. Like, they're empowering the scammers even more??

Thomas Maddrey, The American Society of Media Photographers (ASMP) General Counsel and Head of National Content and Education, noted that OpenSea's current practice is concerning.

"As such a large platform that makes its money on the works of artists, OpenSea has a specific responsibility to ensure it is above board, especially involving its compliance with the DMCA takedown procedures. The Twitter threads show lack of action when notified of copyright infringement," he tells PetaPixel.

It could be argued that OpenSea's practices are an indication that its goals are not well aligned with artists and that it is making the process as convoluted as possible so that it does not have to dedicate large amounts of resources to resolving claims. The NFT space is already rife with ridicule and memes involving "digital ownership" of artwork, and OpenSea's policies don't seem designed to help artists combat them.

Maddrey says that since OpenSea isn't making the process easy, leveraging a DMCA takedown might be an artists' best bet as it is a Federally protected process.

"Section 512 of Title 17 (the Digital Millennium Copyright Act) outlines a procedure for notice and takedown requests. When a DMCA takedown notice is received, the online service provider (OSP) must 'respond expeditiously' to that request. OpenSea has a page dedicated to this matter where they discuss the components of a DMCA notice and how to send one to them," he continues.

"This matter deserves further following to see if the complaints are resolved, and the DMCA takedown procedure requirements are met. I would encourage any person who finds their work used without their authorization on OpenSea or any other platform to send a DMCA takedown notice. You can find out much more about the DMCA takedown procedure at the Copyright Office."
