@trogluur

Because ALL crime and punishment is #political. And power isn't held to the same standard as the rest of us.

#Wagetheft (employer cuts time illegally from worker time cards) is the largest theft type, even when adding all other theft together.

Steal $100 from the register? You get arrested and criminal matter.

Employer steals from employee $100 by manipulating time cards? Oh that's a civil matter. Hope you can afford a lawsuit and loss of your job.

Murder is also a #socialconstruct.

If you poison someone else and they die, its murder.

If you make policy that leeches lead and poisons a whole city, and kills many, you get a governorship in Michigan, and a fellow at Harvard.

#Money , Is both power and a symbol of your effort. Within a certain amount, is a useful method of dividing the commons, trading goods and services and allowing people control over their lives and choices. Its something you earned.
After a certain amount it stops being something about what you earned and much more about power. That power now has the power over other people instead of just power over oneself. This allows you to change the rules of the game, put pressure on desperate people to sell their labor for less, and ensure the laws don't apply to you. Up to a certain point like an analogy its very useful and beneficial, after a certain limit it starts to break down and becomes at best useless and at worst dangerous.
Its why #Proudhon called for money to be replaced with single use labor credits, that couldn't be used to create more money off of others.

And establish new agreements that are less harmful and more beneficial. The hope for some of us is that sorting out the new agreements would happen without heads on pikes. Sadly, history has not gone that way. May things change.

Currency & Traffic Lights are examples of number 1; Virginity & Gender of number 2.

Some social constructs can benefit all or parts of society for a time. The beauty is that because they are constructs, mere agreements, that if they prove to stop working for society, if they stop benefitting us, or once we realise they were always harmful means of control (virginity, looking at you) then we can change our minds. We can alter the agreement.

When something is called a Social Construct it is not being said that it doesn't exist, but rather one of 2 things:
1) That society as a whole agrees certain terms, behaviours & beliefs about the thing in question
2) That the most powerful within the society agree that certain terms, behaviours & beliefs about the thing in question benefit them to give more power & so enforce those beliefs on society.

I feel there's something to think about, and maybe I'll go into more detail when I have.

A social construct is an arbitrary, cultural, and zeitgeisty implicit social accord, usually to serve a function in society.
The underlying social construct about gender is not what is manly or womanly, or the number of genders. It is that we assign societal roles based on an identity assigned on genital appearance at birth at all. And if we are to change anything about the social construct around gender, we have to subject it to scrutiny with regard to its function in the current world.

What is the use, what is the verdict when the doctor in the delivery room proclaims "It's a boy!" or "It's a girl!" and jots that down on an official piece of paper? What is the societal cost? Is that sustainable?

Science fiction must escape from the dystopias it has trapped itself in.

We create the future we imagine, so itโ€™s important to imagine what we desire.

These laws trying to #legislate into reality what is inherently a #socialConstruct by creating a legal definition of sex are draconian and fascist, but also insanely stupid. It'd be like trying to make a law stating that the sky was legally blue and only blue and never any other color.

"โ€ฆ is a #SocialConstruct" does not mean it doesn't exist, is unreal, or has no impact. Social constructs are powerful entities for a social species, as they are widely shared ideas, and often represent basic functions. That being said, they are also somewhat arbitrary and can be changed.

Money as a social construct, for example, is the abstract idea of value being exchangeable between individuals. It is important, although capitalism somewhat perverted it with the idea that money alone should make more money, and absurdly on top by the mathematical unstable, exponential interest function - as you see, under capitalism, the social construct of money has changed, and we can change it again.

Gender as another social construct can change, too. The binary gender model has 2 genders, specific biological and physiological properties, traits, interests, social roles, prescriptions on normative behaviour. All this is pretty arbitrarily thrown together, and this social construct in a more egalitarian society loses more and more of its social function, as it is inherently hierarchical; the concept of women being inferior can only work if what is defined as the role of women in a society is valued less, their contributions are made invisible, and their assigned virtues make them dependent.

This is, paradoxically, why successful feminism actually dissolves binary gender and does away with "woman" as a meaningful social trait - it merely becomes a private conviction. Undoing what a woman is socially frees women to be what they can be and want to be.
