It is time for the rest of the world to stand up against Russian and American aggression and their violations of the United Nations Charter. The human race is facing an existential threat caused by overpopulation, global warming, climate change, political/religious conflict, imperialism, war, and the failure of the United Nations to achieve its primary mandate of maintaining international peace and security. If we are going to survive we must change and we must solve the problems which we ourselves have created.
Article 27 paragraph 3 of the UN Charter states: Decisions of the Security Council on all other matters shall be made by an affirmative vote of nine members including the concurring votes of the permanent members; provided that, in decisions under Chapter VI, and under paragraph 3 of Article 52, a party to a dispute shall abstain from voting.
The United States and Russia have violated the Unanimous Consent Clause dozens of times. It is impossible to end armed conflicts when a party to the dispute can block all UN action. The UN Charter is very clear and unambiguous, any party to a dispute before the Security Council must abstain from voting. Article 27 paragraph 3 only makes sense when it is applied to the five permanent members of the Security Council, it is the exception to the Unanimous Consent rule. UN Charter Article 23 Paragraph 1 clearly defines the permanent members of the Security Council, they are: The Republic of China, France, the Union of Soviet Socialist Republics, the United Kingdom of Great Britain and Northern Ireland, and the United States of America. In accordance with the current UN Charter, the Russian Federation and the People’s Republic of China are not permanent members of the Security Council and have no right to vote on issues before the council. The United States, Great Britain, and France must abstain if they are involved in any dispute before the council. The United States is the aggressor in Venezuela and MUST ABSTAIN on any vote concerning that conflict.
It is time for the General Assembly to stand up and hold the United States and Russia accountable for their actions. It is time for the General Assembly to file a complaint with the International Court of Justice and start a publicity campaign to raise awareness of these violations. As a remedy the General Assembly should ask the ICJ to impose a one year suspension of all United Nations rights and privileges for both the United States and Russia. A one year suspension would give the rest of the world time to work toward permanent solutions to the many problems we now face.
