#Trump has opened an investigation into #HarvardLawReview “based on reports of race-based discrimination permeating the operations of the journal,” per an April 28 press release from the US Dept of Health & Human Services [weird].

At issue is whether the #law review’s policies for membership & article selection violate #TitleVI of the #CivilRights Act, which bans #discrimination based on #race, #color & #NationalOrigin in #education programs receiving federal #funding.

PORTLAND (WGME) -- "Maine's Department of Education says it will not sign a letter saying all #DEI programs have been removed from Maine classrooms.

"This is a response to a directive sent out on April 3 by the U.S. Department of Education. It said all state education agencies and local school districts needed to sign off on new Title VI certifications.

"The Maine Department of Education responded Thursday in a notice sent to all Maine schools, saying the Maine Department of Education and schools already comply with #TitleVI of the #CivilRights Act.

"The notice says Maine already submits regular certifications in return for federal funds.

"The notice goes on to say in part, 'After consultation with the Office of the Maine Attorney General, it was determined that signing the new certification would bind the Maine DOE to language of executive orders or other federal guidance without the force of law, and that lacked clarity regarding what was, or was not, prohibited. These were critical considerations, given the potential consequence of a loss of federal funding.'

"The Maine Department of Education says it's not signing the certification and is not collecting signed copies from schools. It went a step further and asked Maine school districts not to sign off on their own behalf.

"The Department of Education adds that it remains committed to faithfully implementing education programs in accordance with all federal laws."

#Harvard professors sue #Trump administration over funding cut threats

"The Harvard chapter of the American Association of University Professors sued the Trump administration Friday over what they call an 'unlawful and unprecedented' attempt to use federal funding cuts to restrict #FreeSpeech.

"The #DepartmentOfEducation announced in late March that it would review $8.7 billion in federal grants and contacts given to Harvard, alleging that the school failed to prevent #antisemitic discrimination on campus.

"The Trump administration then unveiled a broad set of demands on April 4 the university must agree to in order to keep getting federal funding, including cutting all diversity, equity and inclusion programming, and modifying any programming and departments that 'fuel antisemitic harassment.' The administration gave Columbia University a similar set of demands in March, which the school agreed to.

"The lawsuit by the professors' group, filed in #Massachusetts federal court, alleges that the administration's federal funding review violates the #TitleVI of the #CivilRightsAct, which prohibits discrimination in programs that receive federal funds. The court filing says the law requires specific procedures to cut federal funds and that the Trump administration has not taken any of those steps.

"The group said in a press release that the administration's actions are in effort to create a chilling effect among universities and faculty to stop speech that the president does not like.

" 'Eliminating discrimination and protecting all students is important,' said Nikolas Bowie, a Harvard law professor and the secretary-treasurer of the school's #AAUP chapter, in a statement. 'But Trump is defying the Civil Rights Act, terrifying students, and illegally holding hostage grants for hospitals and scientific research so he can accomplish his real goal of punishing academics for our politics.'

"The lawsuit says that the actions by the administration have 'already caused severe and irreparable harm by halting #academic #research and #inquiry at Harvard.'

"This is the second suit that the Harvard AAUP chapter has filed against the Trump administration this year. The first was a joint suit with other chapters, including one from Columbia, over federal efforts to deport #MahmoudKhalil and students that engaged in #ProPalestinian #activism."

#NY public schools tell #Trump administration they won’t comply with #DEI order

"Morton-Bentley wrote that the state Education Department has already certified to the federal government on multiple occasions that it is complying with #TitleVI of the #CivilRightsAct of 1964, most recently in January. He said the federal department is basing its demands to end DEI programs on a faulty legal interpretation.

"'Given the fact that you are already in possession of guarantees by NYSED that it has and will comply with Title VI, no further certification will be forthcoming,' he wrote.

"He also said the administration’s stance is an 'abrupt shift' from the one taken by the first Trump administration, citing comments in 2020 made by then-U.S. Education Secretary Betsy DeVos that #diversity and #inclusion were 'cornerstones of high organizational performance.' He wrote the administration has provided no explanation of why it changed positions."

Louisiana’s lawsuit was just one instance in a spate of
🔥#right-#wing #attacks
against the EPA’s use of #civil #rights law
✅ to regulate pollution in neighborhoods of color. 🔥

⚠️In April, Republican attorneys general from 23 states filed a petition with the Biden administration’s EPA asking the agency to stop using #TitleVI of the Civil Rights Act to regulate pollution.

The effort was led by Florida’s Ashley Moody, and ❌compared the EPA’s efforts at tacking environmental justice through civil rights law to “#racial #engineering.”

The EPA has not yet responded to the petition.

Federal judge rolls back key #civil #rights protections in Louisiana’s ‘#sacrifice #zones

The decision could open the door for other industry-friendly states to follow suit

James Cain, a federal judge in Louisiana who was appointed by president Trump,
decided to
block the Environmental Protection Agency and the Department of Justice from pursuing enforcement actions based on
#disparate #impacts
— or the idea that a 🔸regulation might disproportionately harm one group of people over another. 🔸

A provision of the landmark Civil Rights Act of 1964 known as #TitleVI allows federal agencies to take action against state policies and programs that discriminate on the basis of race, color, or national origin.

Since the EPA’s founding in 1970, however, the agency allowed most of the Title VI complaints that it received to languish without resolution.

In 2015, a coalition of community groups in Louisiana,
with the assistance of the public-interest environmental law organization #Earthjustice,
sued the agency for this practice and won.

Five years later, after president Biden took office,
✅federal regulators finally began addressing the civil rights complaints they received and
✅the EPA announced a civil-rights #probe into #Cancer #Alley
— a stretch of land on the lower Mississippi River between Baton Rouge and New Orleans where
💥over 150 chemical plants pump cancer-causing chemicals into the air of predominantly Black communities💥
— marking 💪🏽a new phase of the agency’s use of Title VI.

The federal government was making significant progress with Louisiana officials in their Title VI negotiations:

Cancer Alley residents’ principle demand
— that state regulators assess whether a community is already exposed to disproportionately high levels of pollution before permitting a new project there
— had made it into a draft resolution document.

❗️But at a certain point in the process, sources told Grist, the talks broke down.

⚠️Then in May 2023, #Jeff #Landry, then the attorney general (and now the #governor) of Louisiana,
filed a lawsuit against the EPA.

On the basis that the agency was overstepping its authority, 💥Landry’s suit challenged not only the EPA’s use of Title VI to regulate pollution in Louisiana,
but 💥also the very legal justification of "#disparate-#impacts" regulation, 👉which reaches thousands of programs across the country
👉and can be used to adjudicate decisions as varied as where a new highway can go or whether a housing practice is discriminatory.

🆘Advocates worried that the lawsuit had the potential to unravel decades of civil rights law.

Judge Cain’s final judgment concurs with Landry’s argument.

🔥In effect, the ruling will make it impossible for the EPA to pursue enforcement actions based on disparate impacts
— but only in Louisiana.

Cain’s judgment comes in the same week as ❗️the EPA’s new Title VI guidance,
which urges state and local regulators to establish safeguards that protect their constituents against discrimination.
