From the fearless Marc Elias’s newsletter, Democracy Docket:

“We should not only give the Congresswoman [McIver] the presumption of innocence — **we should assume the U.S. Attorney’s office is acting with malice and in bad faith.”**

Please support Marc’s important work if you possibly can.

Watson Coleman: "If they can do this to three #federally elected officials with the authority to come and do their job, and they can then also lock up the mayor of the largest city in New Jersey who was on public property ... people just are afraid of this #weaponization of law #enforcement."

I expanded a rant I recently wrote here into a larger essay for my blog. It's about the issue of due process and the weaponization of speed itself as a tool to deny it.

Stop me if you've heard this one before; the Trump regime is cynically employing a rarely enacted policy from the 1960's to intimidate and attack folks critical of Donald Trump, despite that not being what the policy was, or has ever been, intended for. This time its Federal Communications Commission Chairman Brendan Carr, who is targeting some of the largest media corporations in America for investigations under the "news distortion" policy, as part of what certainly looks like a larger plan to revoke the licenses of broadcasters who oppose Trump and the regime's fascist takeover:

arstechnica.com/tech-policy/20

The speech police: Chairman Brendan Carr and the FCC’s news distortion policy

"Andrew Jay Schwartzman, an expert on media law and senior counselor for the Benton Institute for Broadband & Society, told Ars that "the CBS complaint is utterly lacking in merit. What is alleged doesn't come within light-years of a violation of any FCC policy."

The Foundation for Individual Rights and Expression (FIRE), an advocacy group, called Carr's investigation of CBS "a political stunt," an "illegitimate show trial," and an "unconstitutional abuse of regulatory authority." Democratic lawmakers are demanding answers from Carr about what they call "bogus investigations" designed to "target and intimidate news organizations and broadcasters in violation of the First Amendment."

The CBS investigation was also lambasted in comments submitted by Christopher Terry, a professor of media law and ethics at the University of Minnesota, and J. Israel Balderas, a journalism professor at Elon University who is also a First Amendment attorney and a former FCC media advisor.

"The agency under Brendan Carr appears to be, based on the flimsiest of complaints, pursuing media outlets critical of Donald Trump during the 2024 campaign, while ignoring similar complaints from the public about Trump-friendly media outlets," Terry and Balderas wrote. "Being the speech police is not the FCC's job, but enforcing any restrictions in a selective, much less a partisan, way is problematic, and likely to lead to extensive legal actions challenging FCC authority."

This is a long, granular, well-written article that's worth your time to read if you want to understand what Carr and the regime are trying to do here. The short-short version is that the new fascist chair of the FCC is using a rarely enforced policy that probably should have been cancelled years ago, and has almost universally been used in cases where a news outlet is caught staging or creating the news it wants to report, itself, to target Trump's critics in the media - in this case CBS, although the logic is more or less repeatable for any news outlet whose coverage the regime doesn't like. Furthermore, even if Carr weren't crassly weaponizing a sixty year old FCC policy to punish media outlets who (fairly) criticize Trump, the fact that this is purely about silencing critics of the regime in the media is laid bare by the Chairman's proposed solutions - pulling broadcast licenses; something that has literally *never* happened or been recommended before, even in the rare instances the news distortion policy was employed by the agency.

Look folks, I know the vast majority of people reading this don't care about a 60 Minutes interview with Kamala Harris during the election campaign, and lord knows that corporate media hasn't exactly covered itself in glory during the Trump administration; but this is a lot bigger than even a media corporation like CBS. By employing this policy to justify government harassment and targeting of Trump's critics, Carr is making himself and the regime, the finally arbiter of what does and doesn't constitute a "news distortion" in a way this rule was never intended to be used. If they get away with this, or even if they can just successfully use it to justify applying government pressure against an extremely large, well-funded news organization, there's no limit to how far these nazis will take this. This is how a fascist regime transforms the entire media environment into pro-Trump, state news outlets and it won't just stop with the Fox-ification of media orgs either. The FCC has regulatory power over all broadcasters, and unless you want to see a world where the US government is trying to destroy media organizations for taking about the US history of slavery, why oil companies are not your friend, or even just showing trans and other gender-nonconforming characters in our entertainment, this needs to be resisted vigorously and stopped at all cost.

"Rather than using false content to defame a candidate or persuade a voter directly, there were more efforts to polarize the online conversation by drawing on existing divisions"

At the same time, Russian military intelligence (GRU) pushed propaganda into the media landscape through what researchers refer to as narrative laundering. They planted the seed of a story, attempting to have it picked up and distributed by larger and larger media outlets. They would promote these stories through fake personas on social media, made-up think tanks and alternative news outlets.Around the same time, Russian operatives shifted tactics. The number of bots, trolls and fake accounts declined significantly, while hashtag hijacking (where foreign actors take over authentic hashtags to promote inauthentic behavior), which had been used sparingly, remained constant. Rather than using false content to defame a candidate or persuade a voter directly, there were more efforts to polarize the online conversation by drawing on existing divisions. However, foreign actors have found new ways to work around Facebook’s authentication processes. They recruit people who are from and living in the country they are targeting to post or share content that ordinarily the foreign actor’s accounts would have spread. For example, a Russian operative might try to convince an American to knowingly or unknowingly share Russian propaganda. By doing that, they can ensure the content makes it into the conversation without risking Facebook taking down the account or page. Foreign operators have also continued to target legitimate journalists with strategic content in an attempt to push their narrative into the wider media ecosystem.

Trump just told the prosecutors of the DOJ that he thinks it is illegal for journalists to say bad things about him. He even named some specific people that he hates who are attorneys who have won in court against him and his policies. He calls them "fake lawyers" and "horrible human beings."

@briantylercohen explains: "He's telling them that it's not their job to go after terrorists or murderers or predators, but rather to do the political bidding of this president."

Trump used to complain that the DOJ was "weaponized" against him for following the law, but now that's exactly what he's doing. He went to the DOJ leaders and listed his enemies by name, saying they need to be prosecuted.

Trump is weaponizing financial payments: here's what you can do.
"The Trump administration has swiftly graduated from trying to weaponize internal payment systems (the Department of Treasury systems that allow the federal government to pay monies across its different parts, and to the outside world). Now it is trying to weaponize external payments too. It has seized back $80 million that was paid to New York, and is now trying to do the same with $20 billion paid out by the Environment Protection Agency. This is money that was already paid out by the federal government, and is now sitting in other entities’ regular bank accounts. The Trump administration wants to get the banks where the accounts are located (Citibank is the one we know about) to reverse these payments."

I am very suspicious of many of my fellow Christians right now, given how many of them evidently support Donald Trump and his authoritarian populist movement. There is a long tradition of people using my faith to terrorize others. So, one of the things I do as a minister and as a leader of an interfaith organization is to try to make it clear in my talks and other work that religion is not automatically or necessarily good. Religion has been the source of much evil, which we can chronicle throughout our history. In America, we're in a moment where religion is again being used as a pretext for subjugation and discrimination. White Christianity, especially white right-wing Christian fundamentalism, is such a deep and important current within the MAGA movement and today's "conservatives" that I think even many people who are working in mainstream politics don't really understand what's happening. This weaponization of Christianity is very dangerous to the country and our freedoms.
