As I understand it, the challenge here is that there's basically no remedy for individuals harmed by warrantless ICE raids.
In traditional criminal matters, police and prosecutors are disincentivized from conducting warrantless searches and seizures because an Article III judge overseeing the case would toss the evidence and release the individuals.
But because immigration enforcement is a civil matter handled almost entirely from within the executive branch, there's no independent judge that can intervene.
And even when US citizens are swept up in these raids, they basically have no remedy because *Bivens* has been systematically gutted by the Republican-led SCOTUS. You can't sue the US Government for damages from an illegal search or seizure.
At most you can file for habeas corpus, but by the time you can get a lawyer, ICE might have already shipped you halfway across the country to a concentration camp somewhere in a MAGA friendly jurisdiction like the 5th circuit.
Because, again, this isn't a criminal matter, your rights under the vicinage clause that would otherwise protect you from being shipped to another jurisdiction don't apply. And SCOTUS recently ruled that you have to file for habeas where you are being held, not where you were initially arrested, so you might be entirely at the mercy of MAGA-friendly 5th circuit judges a thousand miles from where you were arrested. And that's assuming ICE would even listen to them.
So until the Dems regain full control of at least one branch of government and choose to do something, there's literally nothing stopping ICE from continuing to do this.
