II. Seeking the Death Penalty Pursuant to President Trump's Executive Order, federal prosecutors at the Department, including at U.S. Attorney's Offices, shall seek the death penalty-if that is a penalty proscribed by Congress-for the most serious, readily provable offenses, and if doing so is consistent with the relevant statutory considerations and other applicable regulations and Department of Justice guidance. Absent significant mitigating circumstances, federal prosecutors are expected to seek the death penalty in cases involving the murder of a law-enforcement officer and capital crimes committed by aliens who are illegally present in the United States. This policy applies to the recent murder of U.S. Customs and Border Patrol agent David Maland during a traffic stop in Vermont.
It would also apply to the murder of Debrina Kawam who was burned to death while she was riding the New York City subway, to the extent these are federal capital crimes.
The policy set forth in the March 20, 2018, Memorandum entitled "Guidance Regarding Use of Capital Punishment in Drug-Related Prosecutions" is hereby reinstated. In addition to drug-related prosecutions, the policy shall also be applied to cases involving non-drug capital crimes by cartels, transnational criminal organizations, and aliens who traverse our borders and remain in the United States without legal status.

The Federal Death Penalty Act recognizes other capital offenses that do not necessarily involve murder: treason, espionage, large-scale drug trafficking, and attempted murder to obstruct a drug kingpin investigation. The constitutional standing of these is less certain or at least different.

The only news sources that I could find about the incident are conservative sources. Of course, they are willing to swallow the whole thing line, hook, and sinker, without an ounce of consideration that perhaps the situation is more complex than it is.

Conservatives don't do well with nuance and complexity.

However, the very reporting that I found, as spun as it is in favor of the narrative that this guy was suspended merely for saying the words "illegal alien", reveals problems with this narrative.

Here's what he said:

I'll note here that: this statement does not understand what "illegal alien" means, and none of the journalistic sources that I found correct the mistake.

Can you spot it?

People without green cards are not *necessarily* illegal aliens.

How do I know?

I was one such person. I'll remind you that I moved to the USA from Canada. Yes, I am now a citizen, but I was never ever an illegal alien, even when I wasn't a citizen, and even when I did not have a green card. I did everything legally. The US government knew about me, my whereabouts, etc.

The notion that people without a green card are illegals is nonsense, except to the conservative mind. It is not the first time I run into this conservative misconception.I was once congratulated by a conservative for "becoming legal." Let me repeat it, I WAS NEVER IN THE US ILLEGALLY!

Did someone correct the guy, and he decided to double down? Who knows? I'm not trusting the conservatives on this topic.
