A London woman has made a data complaint after discovering she had been put on a facial recognition camera watchlist at a Home Bargains store after a dispute over 39p worth of paracetamol.

She learned of her entry on a database of banned customers when a member of staff at the store in Grove Farm retail park in Chadwell Heath asked her to leave and directed her attention to a Facewatch sign.

Facewatch is a facial recognition system used by retailers to identify and deter shoplifters by analysing CCTV footage and comparing faces against a private database of known offenders. It triggers an alert to staff when a match is made by the software.

Stores including Asda, Budgens, Sports Direct and Costcutter have used the technology, despite privacy campaigners arguing that the surveillance infringes the rights of shoppers.

"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

What ICE does is, excluding their decision to wear masks, unconstitutional.

Their right to hide their identity is protected explicitly by the Fourth Amendment, and so is mine, and yours, and everyone else's.

In this regard specifically, you're not going to beat them, so you might as well join them.

If you want to walk down the street while wearing a mask for some reason that has nothing to do with COVID, or simply to hide your face, or for no particular reason whatsoever, you sure can.

Your person includes your face.

An Ada Lovelace Institute report says the 'highly fragmented nature of biometrics governance makes it very difficult to know if police use of [facial recognition technology] is lawful';

And, the 'legislative void' identified by Privacy International means even if the Govt. claims the technology is subject to limitations mandated by human rights law, the police seem to be using it increasingly without regard for *any* limits;

Focussed regulation is needed!
