National Womens Law Center:
We, along with our co-counsel, are representing Doctors for America to intervene in the case Catholic Medical Association v. U.S. Department of Health and Human Services et al. in federal court in Nashville, Tennessee. The Catholic Medical Association (CMA) filed this lawsuit to challenge EMTALA guidance issued in 2022 in the wake of the Supreme Court’s erroneous decision overturning Roe v. Wade. We have intervened to ensure that the right to emergency abortion care under EMTALA is defended.

We’re taking action now so emergency abortion care doesn’t get taken away by extremists. CMA is not only asking that its member doctors be able to refuse to provide emergency abortion care—its lawsuit also puts forward an argument that, if accepted, could potentially prohibit all hospitals nationwide from providing certain types of emergency abortion care. In a recent filing, the Trump Department of Justice said that it was looking at the possibility of settling the case, rather than defending EMTALA. We need you with us to fight back.

The latest conservative talking point claims that abortion bans “protect” women from being "coerced" into abortion. But the truth is, the bans are the coercion. Reproductive coercion (Jezebel article) is defined by efforts to control pregnancy outcomes or interfere with someone's reproductive care — and that's exactly what these bans do.

This narrative is nothing more than a manufactured PR strategy. Let’s be clear: the U.S. was just added to the Global Human Rights Watch list (TIME) for "declining civil liberties."
