Das Gericht der Euro­päi­schen Uni­on (EuG) hat heu­te den Ange­mes­sen­heits­be­schluss zum EU‑US Data Pri­va­cy Frame­work (DPF) gericht­lich bestä­tigt. Das DPF bleibt damit voll nutz­bar als Rechts­grund­la­ge für die Nut­zung US-Ame­ri­ka­ni­scher Cloud-Diens­te. Die Ent­schei­dung betrifft aber nur die Ver­gan­gen­heit – über Gegen­wart und Zukunft des DPF sagt es nichts.

Stefan Brink: "Ich hab auch nichts davon gehört, das da jemals Bußgelder verhängt worden wären oder das Anordnungen getroffen worden wären. Das wäre ja das Plausibelste erst mal. Dass eine Datenschutzaufsichtsbehörde in Deutschland oder Europa eine Anordnung trifft […], also einen Verwaltungsakt erlässt, in dem steht drin: 'Hör auf Daten in die USA zu schicken'. Das habe ich aber nicht gesehen."

As a result, there is no longer a quorum for this board to make decisions, rendering it effectively powerless. With this, the #DPF no longer appears to be in compliance and there is a high probability that the adequacy decision will have to be rescinded.
