So it seems like we'll have a #Schrems III next year which, if things stay as they are, will invalidate the obviously inadequate adequacy agreement that could/should have been called #PrivacyShield II (or Safe Harbor III) as it's essentially a copy paste of the previous one(s).

The EU's General Court upholds the Europe-US data transfer pact.
The court dismissed a challenge by centrist French lawmaker Philippe Latombe, who argued that the EU-US deal did not fully respect the EU's data protection rules.
The EU-US Data Privacy Framework is the bloc's third attempt at a framework to protect European personal data in exchanges with the US – the first two were shot down in court.

They still want to force the same square peg in the same round hole.
Do we really need to wait for @maxschrems to make it all the way to the european court of justice *again*, to make it clear once and for all that the only way this #cloudact will ever really be valid, is when not european laws are changed, but when american laws are changed ?
Wie absolut passend, dass ausgerechnet ein Rechtsanwalt uns beruhigen will, dass das ja aus rechtlicher Sicht gar nicht so einfach sei mit dem Datenzugriff. Da kommt es auch nicht von ungefähr, dass #PrivacyShield und #SaveHarbour reine Rechtsabsicherungen waren, mit denen man die Verantwortung von sich weisen konnte, wenn in der Realität dann doch mal was abfließt – etwas für das gute Gefühl, quasi Homöopathie. Alle wussten: Kann eigentlich nicht funktionieren.
Rechtlich mag das alles korrekt sein. Bringen tut es uns nichts.
Und ja, natürlich wird #Microsoft die Feinheiten des EU-Rechts beachten, wenn die #USA unter Trump oder einem anderen Präsidenten Druck machen. Ja ne, ist klar. 🤡
Nein! Doch! Oh! Wer hätte es nur ahnen können, dass #Microsoft nichts zu melden hat, wenn es um Übergriffe aus den #USA auf Server #EU geht - und Abkommen wie #SaveHarbour, #PrivacyShield und Co vollkommen wertlos sind. Europa muss sich auf ganzer Linie technisch von den USA unabhängig machen, wenn man zukünftig frei agieren möchte.

Zum ersten Mal seit er das USA/EU-Privacy Shield für unwirksam erklärt hatte.
