Today is not a day just for feminism.

Today is yet another day to remind ourselves about the intertwinkng of all the issues we face, hence the value of the intersectionality of our fights.

Firstly, and most importantly, we should get used not to call ourselves feminist, but transfeminist. Trans rights are human rights! 🏳️‍⚧️

Let us always recognise how gender violence cannot be decoupled from political, economical, and climatic violence.

Let us see the people around us, by our side, not just those who do not want to accept our freedom. We stand together, or we don’t.

"This is progress!" they declare, while walking right into a mousetrap.

This is about a lot of things. Hate crime laws. Feminists falling back onto gender essentialism. The building of "more inclusive" prisons. Pro-state marxists. And a lot of other stuff.

But this post is about the legal recognition of trans existence. And why a gender marker change or a third gender option is a trap instead of liberation. And why a broadening of options isn't the same as autonomy and how a broadening of options can actually lead to the decay of autonomy.
There are a lot of reasons for this. Firstly it makes the state the ultimate decider of what gender is and isn't if we give it the power to validate our existence. Secondly it influences how we act and which acts we see as possible. And thirdly it reintroduces us to the patriarchal gender structure as a MaGe that is able to be exploited.

On the first point:
The state has the ultimate power to decide what gets to be on the documents it hands out. This reenfocres to notions. The notion that the state is the arbitrer of truth and the notion that gender is something that is declared from a powerful other, aka the patriarch.
So to just broaden the options of what happens on legal documents we hand our own identity over to the hand of the oppressive other, so that it may decide who we are and who we are not. In this destroying any possibility of autonomous gender declaration.
Even if there was such an option as writing in whatever we feel like it would still be a state-declared document. Our gender would still remain legal subject of the state and the colonialist patriarchal structure.

On the second point:
Germany has the option for a third gender declaration on its documents. Germany is also more and more embracing its inherent fascism.
We had a lot of conversations with other nonbinary, agender and other people who dont feel represented by the binary who were thinking about changing to a third gender category on their legal documents but are afraid of what that would mean in the future.
Because it can easily become a target on their back.
But even if it doesn't it will still put force on them to act a certain way. In some situations this change on the documents might offer a shield, but it will also be a chain on how they can act. There is a social expectation on how somebody who is "diverse" (the name of the legal gender category) has to act.
Other people will see the change on their document and expect a certain way for them to act, which they will either continously have to rebel against or will have to embrace. And while that isn't all that different from what being trans already is, it still brings with it the extra weigth of the legal apparatus and the constant insecurities of it.

On the thrid point:
Talia Bhatt describes it much better in her text "The Third Sex", but introducing a new gender category to a patriarchal strucure has historically lead to this third gender category to be neatly fitted into the larger structure as another subservient MaGe under the category of women. Pushed to the fringe of society, often into spiritual roles which come with even more norms and rituals to follow than larger society already puts on us.
Through this we become subservient to our gender instead of it being the battlefield of liberation it yearns to be.

This is why a broadening of options, a building of new camps of power can never be the answer to the structures around is. Only the abolition and destruction of all that is can lead to total liberation. Don't fall back onto the traps of legalism and its bureaucratizing of power. Because in the end the broadening of power will always just benefit the ones at the top of the power structure.
