"夫婦間であっても、相手の同意なく性行為を強要することは「不同意性交等罪」に該当し得ます。
2023年に改正された刑法には「婚姻関係の有無にかかわらず」と明記されており、暴行や脅迫がなくとも、精神的圧力などで相手が抵抗できない状態に乗じて性行為を行えば犯罪が成立します。
さらに、夫の一連の行為は、DV防止法が定めるDVにも該当することが考えられます。
同法が対象とする「暴力」は、殴る蹴るといった身体的暴力に限りません。異常な性行為の強要は「性的暴力」、人格を否定する暴言は「精神的暴力」にあたり、いずれも同法が定める「心身に有害な影響を及ぼす言動」に含まれます。

DV加害者プログラムに参加する男性の半数以上は「家事育児に積極的な男性」で、「僕の方が効率的で合理的だよ、君はどうして僕みたいにできないの？」「もっと論理的に説明できないの？」と妻を「無能力者」扱いすると。根底にあるのは、「妻は自分の思い通りになるべき」という家父長制の価値観。プログラムに参加する男性のほとんどは「妻のせいで参加することになった」「むしろ自分は被害者だ」と認識。DVというと暴力を想像しがちだけど、こうした精神的DVこそ目を向ける必要性。信田さん「だから私は、モラハラという用語は使いません」。
